Is psilocybin legal in New Jersey? The 2026 law, and where retreats are legal
New Jersey passed a psilocybin law in January 2026, but it does not open public access. What the law does, where guided psilocybin is legal, and what New Jersey residents should know.

Not for general use. In January 2026 New Jersey enacted a law creating a psilocybin therapy pilot program at up to three hospitals, but it does not open public access, and psilocybin remains a controlled substance under state and federal law. Legal guided psilocybin services exist today in Colorado and Oregon.
We are asked about this more than almost anything else, usually by people in New Jersey who have read about psilocybin research and want to know what is real. This article sets out the law as of October 2026, with sources. It is general information, not legal or medical advice.
What the 2026 New Jersey law does
On January 20, 2026, in his final days in office, Governor Phil Murphy signed a bill sponsored by Senate President Nicholas Scutari that creates a psilocybin behavioral health pilot program. In outline:
- The Department of Health is to choose up to three hospitals, one each in the north, center and south of the state, to provide psilocybin therapy to qualified patients.
- The program is aimed at conditions such as PTSD and depression that have not responded to other treatment, and it is meant to be studied as it runs.
- The law sets aside $6 million for the pilot, shared among the participating hospitals.
- It creates a Psychedelic Therapy and Research Advisory Board, and gives the Department of Health about two years to set licensing standards for psilocybin manufacturers, service centers, testing labs and facilitators.
What it does not do is let anyone buy, possess or use psilocybin outside that program. As News 12 New Jersey reported when the bill was signed, psilocybin is still a Schedule I controlled substance. For current details on the pilot, including which hospitals are taking part, check with the New Jersey Department of Health.
Is psilocybin legal anywhere in the US?
Yes, in a few states, inside regulated programs, and always still illegal under federal law.
Colorado. Voters passed the Natural Medicine Health Act (Proposition 122) in 2022. Adults 21 and older can receive psilocybin services from a licensed facilitator, usually at a licensed healing center. There is no residency requirement, so people from New Jersey can take part. Our guide to Colorado's law explains the rules in detail.
Oregon. Oregon's licensed psilocybin services program, approved by voters in 2020, also serves adults 21 and over at licensed service centers.
New Mexico. In April 2025 New Mexico enacted the Medical Psilocybin Act, which sets up a medical program for qualifying conditions, run by the state Department of Health.
In every case, the legal service happens in that state, under its rules, and the psilocybin stays there. Do not take psilocybin across state lines.
Does Halcyon offer psilocybin in New Jersey?
No. Halcyon's house on Lake Hopatcong does not offer psilocybin, and no one should offer it to you at any retreat in New Jersey outside the state's pilot program. If a New Jersey retreat says otherwise, it is operating outside the law.
What the house does offer is quieter: breathwork, meditation, sound baths and somatic work led by independent practitioners, and, through our licensed clinical partner Presence of Mind Therapy, ketamine-assisted psychotherapy, which licensed clinicians can provide in New Jersey. Halcyon itself does not provide medical services.
Maureen Lennon-Schafer and Presence of Mind Therapy
For New Jersey residents who want to explore psilocybin legally, we partner with Maureen Lennon-Schafer, LCSW, the founder of Presence of Mind Therapy. She is a licensed clinical social worker, licensed in New Jersey and Colorado, with offices in Mountainside, Summit and Metuchen. Her clinical work centers on trauma, grief and Internal Family Systems.
In Colorado she is a Licensed Natural Medicine Facilitator of psilocybin, trained through Fluence, one of the state's approved training programs. She leads small, guided three-day retreats near Boulder: a preparation session, one guided session at a licensed healing center, and an integration session, with the group staying together in a shared house and facilitators present throughout. See the program and dates on our Boulder retreat page, and what it costs in our Colorado retreat cost guide.
One person who worked with Maureen wrote about it for us in his own words: My journey with psilocybin-assisted therapy and alcohol recovery. As he put it, psilocybin did not replace the work of recovery. Nobody can promise a result, and Maureen says so plainly to the people she works with.
Travelling from New Jersey to Colorado
Colorado's law defines a participant by age, not residency. A few practical points for New Jersey residents:
- Start with screening. Every participant is screened. If screening finds a risk factor, Colorado's rules accept a referral or clearance from a provider licensed in your home state, so your own New Jersey doctor or therapist can be part of it.
- Talk to your prescriber early if you take medication. Some medications, lithium in particular, call for real caution. Never stop or change a medication on your own to fit a retreat.
- Book travel after you are accepted, not before.
- Come home with the experience, not the medicine. Psilocybin in Colorado's program is taken during the supervised session and is not sold to take away.
Our guide for out-of-state visitors covers this in more depth, and the safety page and who should not attend explain screening and contraindications.
How to spot an offer you should not take
Interest in psilocybin has brought a wave of offers that sit outside any law: "retreats" in states without a program, sessions in private homes, mushrooms sold online or shipped. Colorado's Natural Medicine Division has published consumer alerts about natural medicine fraud and scams. A few checks help:
- Where will the session happen? Legal guided psilocybin services happen in a state with a program, at a licensed site. In New Jersey, the only legal setting is the hospital pilot.
- Is the facilitator licensed? In Colorado you can confirm a facilitator's license with DORA's license lookup, and check a healing center in the Natural Medicine Division's directory.
- Is anyone selling you the medicine? Colorado prohibits sales outside its licensed system; you pay for services, not mushrooms.
- Is there screening, preparation and integration? A regulated program requires all three. An offer that skips them is skipping the parts that protect you.
Other legal routes for New Jersey residents
Clinical trials of psilocybin enroll participants in several states, including some near New Jersey. You can search for current trials on ClinicalTrials.gov. Trials have strict criteria, and taking part is not the same as receiving treatment, but they are a legal route that some people choose.
